CALL TO ORDER / ROLL CALL - COUNCIL
Mayor Parker called the Closed Session to order at 6:00 p.m., all members were present.

1. Public Comment
None.
             
Closed Session may convene to consider matters of purchase / sale of real property (G. C. §54956.8), pending litigation [G.C.§54956.9(d)(1)], potential litigation [G.C. §54956.9(d)(2)(3) or (4)], liability claims (G. C. §54961) or personnel items (G.C.§54957.6). Records not available for public inspection.

Mayor Parker called the Study Session to order at 6:30 p.m., all members were present.
             
3. Public Comment
None.
             
4. Clarify Regular Meeting Topics
Mayor Parker inquired on Agenda Item No. 17, Imperial Highway Frontage Road Speed Hump Installation, as to the type of speed hump proposed to be installed.

City Manager Gallardo clarified that the speed hump for the proposed installation would be continuous in design.

6. Pledge of Allegiance:
Boy Scout Troop 801 led the Pledge of Allegiance.
             
7. Invocation:
Doug Green, North Hills Church delivered the Invocation.
             
8. Commendations:
Mayor Parker, on behalf of the City Council, presented Pastor Richard Dannenbring, Christ Lutheran Church and School, with a Commendation for his service.
             
9. Report - Prior Study Session
None.
             
10. Community Announcements
Councilmember Simonoff announced that tickets are now available for the 2018/2019 season of the Curtis Theatere. The season opens up with “RagFest” on September 29, followed by “One-Hit Wonders” and the “Halloween Spooktacular” in October. He also reminded the everyone to register for Brea Youth Theatre’s production of “Seussical.” The deadline to register in the production is Wednesday, October 24 at 5 p.m. For more info on the new Curtis season, visit CurtisTheatre.com.

Councilmember Hupp encouraged the community to get prepared and register for Brea's free CERT classes. The Brea Community Emergency Response Team, or CERT program, educates people about disaster preparedness and trains them in basic disaster response skills. Sign up early as class space is limited. Visit cityofbrea.net/cert to register.

Mayor Pro Tem Marick invited the community to join the City and the Brea Olinda Unified School District for the dedication of the new Lagos de Moreno Park/ Laurel Elementary Magnet School Playground. The new playground will be unveiled on Friday, September 28 at 1 p.m.

Councilmember Vargas encouraged everyone to volunteer and help the community clean-up local watershed at Inner Coastal Cleanup Day on Saturday, September 15 from 8-11 a.m. He noted that this is a great event to help keep our local waterways and community clean. The annual effort supports a state-wide program to protect our natural environment. For more information on how to participate, visit cityofbrea.net.
             
11. Matters from the Audience
Sean Thomas spoke regarding the financial state of the City, the use of consultants, transparency and the proposed development fee increase.

Robert Laughton spoke regarding Agenda Item No. 17 and requested the City seek other traffic and speed reduction measures in lieu of spending money on the speed hump.

Keith Fullington spoke regarding home break-ins, and the financial state of the City.

Linda Silva discussed Heritage Plaza Senior Apartments.
             
12. Response to Public Inquiries - Mayor / City Manager
Mayor Parker, City Manager Gallardo, Councilmember Hupp, Councilmember Vargas, Public Works Director Olmos and Chief Conklin responded to public inquiries.
             
ADMINISTRATIVE ITEMS - This agenda category is for City Council consideration of a wide variety of topics related to the City's operations. Public comments regarding items in this section should be presented during " Matters from the Audience."

Proposal to amend definitions related to wireless facilities, prohibit short-term rentals, and amend Title 20 of the City of Brea Zoning Ordinance
City Attorney Markman read the full title of the ordinance. 
  Motion was made by Council Member Simonoff, seconded by Council Member Hupp to adopt an Ordinance of the City Council of the City of Brea adopting Zoning Ordinance Amendment No. ZOA 18-01, amending definitions related to wireless facilities, prohibiting short-term rentals, and amending Title 20 the City of Brea Zoning Ordinance.

14. Review of Process for Appointment and Removal of Council Appointed Commissioners
City Manager Gallardo introduced the item and explained the background of the item, past Council discussion, recent appointments, current process, 2017 City Attorney survey and options for consideration. 

Mayor Parker discussed the current appointment and removal process, modification of the current process and goals and objectives for the new process. 

Councilmember Hupp stated that she is in favor of the third option presented, stated she is in support of a public interview process for the Planning Commission and stated that she is not in favor of unilateral dismissal. 

Mayor Pro Tem Marick stated that she is also in favor of the third option and stated support for the public interview process for the Planning Commission, noting the importance of the Commission.  

Councilmember Vargas expressed support for selecting candidates based on qualifications, and noted possible concerns with the public interview process deterring potential candidates. 

Mayor Pro Tem Marick noted support for the continuance of staggered terms, and noted that the removal process should mirror the appointment process. 

Councilmember Simonoff discussed the history of how Council has appointed Commissioners, and expressed support for a full Council interview with applicants. 

Mayor Parker spoke of an option which still gives a Councilmember a nomination process. 

City Attorney Markman noted that during a public meeting interview process, the open meeting setting would allow for public comment.  

Council discussion ensued regarding staggered terms, and diversity.  

City Manager Gallardo and City Attorney Markman summarized Council discussion and direction, which will come back with a proposed Ordinance for consideration. 
             
CONSENT CALENDAR - The City Council/Successor Agency approves all Consent Calendar matters with one motion unless Council/Agency or Staff requests further discussion of a particular item. Items of concern regarding Consent Calendar matters should be presented during “Matters from the Audience."

The City Council approved the August 21, 2018 City Council Regular Meeting Minutes. 
             
16. Southern California Gas Company Easement on City Owned Parking Lot for Gas Service for 180 S. Brea Boulevard
The City Council approved the Grant of Easement to Southern California Gas Company. 
             
17. Imperial Highway Frontage Road (Jasmine) Speed Hump Installation
The City Council approved the Imperial Highway Frontage Road (Jasmine) speed hump installation.

  Motion was made by Council Member Simonoff, seconded by Council Member Vargas to approve City Council Consent Calendar Items 15-19.
