CONDITIONAL USE PERMIT NO. CUP 19-02 – A REQUEST TO ALLOW THE ON-SITE SALES OF BEER AND WINE AT GREENS N THINGS RESTAURANT LOCATED AT 975 EAST BIRCH STREET, SUITE A IN THE MIXED USE I ZONE, MU-I.
REQUEST
Greens N Things is requesting to serve beer and wine in conjunction with food service.
RECOMMENDATION
Staff recommends the Planning Commission approve Conditional Use Permit No. CUP 19-02, subject to the conditions in the draft Resolution.
BACKGROUND/DISCUSSION
BACKGROUND  
Greens N Things is a casual sit-down restaurant located in the Brea Marketplace, see Figure 1- Vicinity Map.  The restaurant is approximately 3,000 square feet  The business includes a full service kitchen serving breakfast, lunch and dinner as well as a fresh smoothie and juice bar, specialty coffees and protein shakes.

The business is open Monday through Friday from 8:00 am to 9:00 pm and Saturday and Sunday from 9:30 am to 8:00 pm.    
 
DISCUSSION
The business is requesting to add beer and wine sales to their menu options.  In order for a restaurant to sell beer and wine, they must obtain an On-sale Beer and Wine license from the State Office of Alcoholic Beverage Control (ABC).  Additionally, the City of Brea allows businesses in the Mixed Use-I zone to sell/serve beer and wine with the approval of a Conditional Use Permit.  This review is to ensure the use is consistent and compatible with adjacent uses.
 
The addition of beer and wine in conjunction to this restaurant use as proposed is similar to other restaurant in the City and in the center where Greens N Things is located, including: Stonefire Grill, D’Vine, Rubio’s, and Kabuki.   The sale and service of beer and wine is consistent with City Code and is compatible with the goals and objectives of the General Plan.    The hours of operation are consistent with other businesses in the center and are compatible with the adjacent commercial and residential uses.  The request to add the sale/service of beer and wine in conjunction with the existing restaurant as requested is not expected to have negative impacts on surrounding businesses or residents.  The proposed conditions of approval contained in the draft Resolution require the business operations to remain in compliance with all requirements of Alcohol Beverage Control Department.  
ENVIRONMENTAL ASSESSMENT
The proposed project is exempt from the requirement of the California Environmental Quality Act (CEQA) pursuant to Section 15301 of Title 14, Chapter 3, Article 19 of the California Code of Regulations.
