Final Parcel Map 2016-175 and Public Sidewalk Easement for Property Located on 404 North Berry Street, 424, 428, 430 & 436 North Berry Way
RECOMMENDATION
Accept Final Parcel Map 2016-175 and Public Sidewalk Easement.
BACKGROUND/DISCUSSION
The property located at 404 North Berry Street and 424, 428, 430 & 436 North Berry Way is approximately 15.69 acres with a General Plan Designation of General Industrial (M-2). Currently, there are 5 existing industrial buildings and several accessory structures on the site.  The proposed subdivision, Tentative Parcel Map 2016-175 (TPM 2016-175), would subdivide the property into six (6) parcels.  There is no proposed development at this time and all existing buildings are proposed to remain.  See Exhibit 'A' - Location Map attached herein.
  
On July 25, 2017, the Planning Commission conditionally approved TPM 2016-175 pursuant to Resolution PC 2017-10.  As part of the Conditions of Approval ("COA"), the property owner is required to construct the public sidewalk on the portion of the property (Parcel 1) fronting Berry Street.  Furthermore, the property owner is required to submit conceptual plans for review and approval for other improvements.  These other improvements include street improvements for Berry Place and Berry Way (both are private streets), water improvements to abandon the existing public water main and construct private domestic water, private fire water system and storm drain improvements to convey storm runoff from the future developments.  Since there is no proposed development at this time, these other improvements are deferred to be constructed as part of any future development. 
     
The Final Parcel Map 2016-175 (Final Map) has been approved by the County Surveyor’s Office for technical correctness and the City Engineer has determined the Final Map to be in compliance with the State Subdivision Map Act, in conformance with the Tentative Parcel Map, and with City ordinances.  The property owner has deposited $3,280 to guarantee payment for setting of the monumentation in accordance with Subdivision Map Act Section 66496.  The improvement plans to construct a public sidewalk on Berry Street have been reviewed and approved by the City Engineer.  In addition, staff has reviewed the COA for this development and have determined that the associated Final Map conditions have been met.  Refer to the Final Parcel Map 2016-175 attached herein.

The public sidewalk easement to be dedicated for the proposed sidewalk on Berry Street as shown on the Final Map does not cover the easement area needed based on the final approved improvement plans.  Therefore, the property owner is dedicating the remainder of the public sidewalk easement area through a separate conveyance instrument.  This easement dedication document will be recorded after the Final Map is recorded.  The easement document is attached herein for City Council's reference.
      
Additionally, since the approval of the TPM 2016-175, the property owner decided to install portions of the improvements that were deferred in the COA.  The improvements to be constructed are: installing public water and fire services on Berry Street and Lambert Road, installing private fire water systems, installing private storm drain systems, and constructing portions of the private street improvements that are not interfering with the existing facilities.  The remainder of the improvements, which interferes with the existing facilities, will be constructed as part of any future development as specified in the COA.  The improvement plans for the aforementioned improvements are being reviewed and approved by Fire Department, Building and Safety Division and Engineering Division.
FISCAL IMPACT/SUMMARY
The property owner has paid all required fees associated with this Final Map, Improvement Plans, and Conceptual Plans and has deposited $3,280 to guarantee payment of setting of the monumentation.  Therefore, there will be no General Fund impact from the recommended action.

The Final Map has been approved by the County Surveyor's Office and City Engineer.  The Public Sidewalk Easement document has been reviewed and approved by the City Engineer.   Staff has reviewed the COA for this development and has determined that the associated Final Map conditions have been met.  Therefore, staff is recommending City Council consider acceptance of the Final Parcel Map 2016-175 and the public sidewalk easement on Berry Street.
