RECOMMENDATION
1. Accept Final Parcel Map 2017-131
2. Approve Subdivision Improvement Agreement and Bonds
BACKGROUND/DISCUSSION
The property located on the south east corner of Lambert Road and Brea Boulevard is approximately 1.7 acres with a General Plan Designation of General Commercial (C-G) Zone.  Currently, the property is fully developed with one (1) existing building and (1) accessory structure.  The address for the existing building is 390 N. Brea Boulevard.  The existing building was utilized as a bank (Wells Fargo Bank) and the accessory structure was used as the bank drive-thru. The existing building and site have been vacant for the last few years.  See Exhibit 'A' - Location Map attached herein.
 
The proposed subdivision, Tentative Parcel Map 2017-131 (TPM 2017-131), subdivides this property into two (2) parcels with Parcel 1 being 1.3 acres and Parcel 2 being 0.4 acres.  TPM 2017-131 was conditionally approved pursuant to Planning Commission Resolution PC 2017-09 on June 27, 2017.  The Planning Commission also approved the construction of a CVS Pharmacy building on Parcel 1 and the Coffee Bean and Tea Leaf with drive-thru on Parcel 2.

The property owner (390 N. Brea, LLC) is required to construct three new driveway approaches to replace three existing driveways, remove one existing driveway to construct new curb, gutter and sidewalk, as well as installing all new utility services for the proposed two new buildings pursuant to the Conditions of Approval within Resolution PC 2017-09.  The improvement plans for the required improvements have been reviewed and approved by the City Engineer.  The property owner (390 N. Brea, LLC) and its tenant (Garfield Beach CVS, LLC) have entered into a Subdivision Improvement Agreement ("SIA").  The SIA was prepared, reviewed and approved as to form by the City Attorney.  In accordance with the SIA terms, Garfield Beach CVS, LLC has provided a Performance Bond and Payment Bond each in the amount of One Hundred Twenty-Four Thousand and Seven Hundred Dollars ($124,700) for the construction of aforementioned improvements.
  
The Final Parcel Map 2017-131 (Final Map) has been approved by the County Surveyor’s Office for technical correctness and the City Engineer has determined the Final Map to be in compliance with the State Subdivision Map Act, in conformance with the Tentative Parcel Map, and with City ordinances.  In addition, staff has reviewed the Conditions of Approval for this development and have determined that the associated Final Map and improvement plan submittal conditions have been met.
FISCAL IMPACT/SUMMARY
The property owner has paid all required fees associated with this Final Map, Improvement Plan, and SIA.  Therefore, there will be no General Fund impact from this recommended action.

The Final Map has been approved by the County Surveyor's Office and City Engineer, the property owner and its tenant have entered into a SIA and posted a Performance and Payment Bond each in the amount of 100% of the improvement costs ($124,700), and the associated Final Map and Improvement Plan conditions for the development have been met.  Therefore, staff is recommending the City Council consider accepting the Final Map and approving the SIA with associated bonds.
