Sewer Lift Station for La Floresta Development
RECOMMENDATION
1. Adopt Resolution to Accept Irrevocable Offers to Dedicate Lot QQ of Tract 17150 for Sewer Lift Station,
2. Accept Sewer Lift Station Improvements, and
3. Approve Access Easement Agreement for Sewer Lift Station.
BACKGROUND/DISCUSSION
Tentative Tract Map 16934 for the La Floresta Development was conditionally approved by Planning Commission Resolution No. PC 2010-57 on September 23, 2008.  The property is located at the northeast corner of Imperial Highway and Valencia Avenue, formerly known as Unocal Research Center.  During the initial review of the La Floresta project, the sewer system was planned to discharge into the City of Placentia’s sewer collection system.  The City of Placentia wanted the developer to substantially upgrade their sewer mains and it was decided to install a sewer lift station that would pump the material north and directly into the OCSD main trunk line in Rose Drive.  See attached Exhibit 'A' for sewer lift station location.

Subsequently, the final conveyance Tract Map 17150, a part of Tentative Tract Map 16934, was approved by City Council on May 11, 2011.  This final map subdivided the La Floresta development into 19 number lots for future planning areas and 48 letter lots for private streets, landscape open space and the sewer lift station.  Lot QQ was irrevocably offered to dedicate to the City of Brea in fee for sewer lift station purposes on Tract Map 17150.  However, at the time of final map approval, the City Council rejected the dedication until such time when the sewer lift station improvements were completed.  A copy of the map is attached as Exhibit 'B' for reference.  Now that the sewer lift station has been completed and the conditions of approval associated with this have been satisfied, Lot QQ will need to be accepted as part of the sewer lift station acceptance. 

The construction of the sewer lift station was completed and has been in operation since May, 2014.  It was stipulated in the development agreement for La Floresta development (DA 08-01) that the master developer, La Floresta, LLC, would operate and maintain the sewer lift station until the 300th occupancy before the City accepts the sewer lift station.  La Floresta development was granted the 300th occupancy, hence, the sewer lift station is ready for the City to accept and maintain.  However, in order for the City to begin maintaining this sewer lift station, an access easement is required over the landscape lots (Lot KK and Lot LL) with the offer to dedicate Lot QQ. 

These landscape lots are currently owned by La Floresta Maintenance Corporation (HOA).  Therefore, the terms and conditions for the access easement are included in the Access Easement Agreement (Agreement) between the City and HOA.  This Agreement has been reviewed and approved as to form by the City Attorney's office.
FISCAL IMPACT/SUMMARY
The majority of the La Floresta development is served by this sewer lift station and proper operation and maintenance is needed. Jamison Engineering has been maintaining this sewer lift station for the past years for the developer.  In addition, City Council approved the Maintenance Agreement with Jamison Engineering on May 31, 2016, in anticipation of accepting the sewer lift station improvements.  The ongoing maintenance cost will be covered by the Sewer Fund.  Therefore, there will be no General Fund Impact.

Staff is recommending the acceptance of the Lot QQ dedication and sewer lift station improvements, as well as approving the Access Easement Agreement to finalize the sewer lift station and take over the maintenance in accordance with the La Floresta Development Agreement.
