Adopt Ordinance No. 1205, Commissioner Appointment and Removal Procedures and Amendment to the Brea City Code
RECOMMENDATION
Approve and adopt second reading of Ordinance No. 1205 updating the process for appointment and removal of Council Appointed Commissioners and amending the Brea City Code.
BACKGROUND/DISCUSSION
In previous meetings, City Council has discussed current procedures for appointment and removal of Council appointed commissioners. During these discussions, ideas regarding a new procedure for appointment and removal were deliberated, particularly concerning the Planning Commissioners.

At the 10/2/18 Council Meeting, two drafted ordinances were presented to Council, and a decision was made to select Option 2 titled "Universal Nominations". This chosen ordinance requires City Council to interview all Planning Commission applicants via a special meeting, then each Council Member nominates an applicant for appointment. Council appoints the nominated applicants via a majority vote. Appointment procedures for the two other commissions, Cultural Arts Commission and Parks, Recreation, and Human Services Commission, would remain unchanged.

This ordinance also addresses removal procedures. Removal of a member of any commission would be made upon a majority vote of the Council Members, one vote which must include the Council Member who nominated the commissioner, unless the Council Member is no longer on the Council. Alternatively, if the Council Member who nominated such commissioner is opposed, the removal may be made upon a four-fifths (4/5) vote of the City Council. 

The first reading of Ordinance 1205 was on October 2, 2018.
